PA A.G. Issues Legal Opinion...80% Lowers Are A Gun

This was from a week ago and was slipped in under the radar by a mostly quiet media. PAFOA didn't miss it thought. They are claiming that over a hundred of these guns were taken off of prohibited people this year in Philly alone. That number makes me think someone is finishing them and illegally selling them into the criminal black market so their opinion will not stop an already illegal act.

From the opinion: “My Office is taking the initial step of clarifying – through my official, legal opinion – that under Pennsylvania law, 80% receivers are firearms and can be treated, regulated, and enforced as such”

“If we don’t recognize that 80 percent receivers are firearms under Pennsylvania law, we are creating a giant loophole that allows criminals to skirt our agreed-upon laws that keep people safe,” said Gov. Wolf. “Changing this classification will not hurt legal, responsible gun owners – This change will stop criminals, terrorists and other people who can’t pass a background check from acquiring a gun through the loophole.”

Now that the legal opinion is issued they will work with the PA state police to decide on enforcement. It sure makes it sound as if the A.G. and Governor Wolf (socialist wannabe) are planning on requiring background checks for 80% lowers.

Yep, and not only that, it is in direct conflict with federal ATF 4473 for several reasons.

1. There is no serial.

Any firearm manufactured COMMERCIALLY after the enactment date of the GCA in 1968 is required to have a serial number. That is federal law.
Individuals are not required to mark a firearm in any manner, unless it is to comply with the NFA, or unless they choose to pay the tax, be licensed and begin manufacturing firearms.

2. There is no serial because it is not a firearm per atf regulations.
It is nothing more than a hunk of metal. If anyone doesn't like that someone makes a gun using tools and their hands, are sure to not want to watch any of the videos at the end of my post.

3. The ATF recently got their pee pee smacked by a court regarding receivers anyway, so I'm positive that the ATF will not want any part of this.

I don't think they really don't care. They seem to want to make laws or rulings they know won't past muster and will be challenged. The governor was in Pittsburgh earlier this year supporting that city enacting local laws that violate our preemption laws and state Constitution...the very laws he swore to uphold.
