Biden DOJ Classifying Gun Parts as ‘Firearms’ in Effort to Ban ‘Ghost Guns’

Biden DOJ Classifying Gun Parts as 'Firearms' to Ban 'Ghost Guns' (breitbart.com)
11 Apr 2022

Democrats use the phrase “ghost guns” to describe firearms that Americans can build themselves. The firearms are often built from an 80 percent receiver in the case of a rifle, or 80 percent frame, in the case of a pistol. Building such guns has long been an American hobby. The new rules from Biden’s DOJ refer to the 80 percent parts kits as “buy, build, shoot” kits and label the kits themselves as firearms.

On May 7, 2021, Breitbart News
:link: noted that Biden’s DOJ was pushing news rules to require a background check to acquire the gun parts kit necessary to build a firearm at home and also to require that Federal Firearm License holders (FFLs) add a serial number to any previously built or 3D-printed guns that “they take into inventory.”

Attorney General Merrick Garland commented on the proposed changes, saying:

We are committed to taking commonsense steps to address the epidemic of gun violence that takes the lives of too many people in our communities. Criminals and others barred from owning a gun should not be able to exploit a loophole to evade background checks and to escape detection by law enforcement. This proposed rule would help keep guns out of the wrong hands and make it easier for law enforcement to trace guns used to commit violent crimes, while protecting the rights of law-abiding Americans. Although this rulemaking will solve only one aspect of the problem, we have an obligation to do our part to keep our families and our neighborhoods safe from gun violence.

The new rules
:link: to be announced by Biden and Deputy Attorney General Lisa Monaco follow through on the early 2021 proposal by requiring that FFLs add serial numbers to any unserialized gun taken into their possession:

The Justice Department is requiring federally licensed dealers and gunsmiths taking any unserialized firearm into inventory to serialize that weapon. For example, if an individual builds a firearm at home and then sells it to a pawn broker or another federally licensed dealer, that dealer must put a serial number on the weapon before selling it to a customer. This requirement will apply regardless of how the firearm was made, meaning it includes ghost guns made from individual parts, kits, or by 3D-printers.

There are several big lawsuits against this.

Two of them failed to have injunctions, the other, they said they would hear them in a week or two to see if there should be an injunction.

Truth is, the atf was making changes up to two days prior to the enactment date, which is not allowed because it had not went through the public comment.

The brace ban thing has been pushed back until after the november elections. And it was supposed to be in effect already.

And not to mention, after the bruen/epa case, that should have stopped the atf in its' tracks too because agencies are not allowed to make up law. That is congress' job.

So, I do not believe that it's going to last very long.

If Congress ever actually did anything in a way people could understand, then they would have to explain to the people why things are not working out. Nowadays they can just blame the opposition, and sling bullshit.
California has been pushing the same law about firearm parts being considered the firearm itself. Of course it would be pretty hard to prove where any particular part came from if every part manufacture does not serialized.

No problem, they said, just serialize every single part of the gun.

They didn’t realize this will double the cost of a gun, or they didn’t care.

Serializing every part is stupid. Especially over time as parts wear out and have to be replaced.

With parts from other guns with different serial numbers.

Then you have a gun with all kinds of numbers on it that nobody still knows where it came from or who it belongs to.

(1) Do not comply...
(2) Get your asses out there and VOTE these cretins OUT of office. Voting (R) is usually a safe bet but don't vote for some spineless pussy! THEY and RINOs need to go!
(3) Volunteer at your local polling place to keep an eye out for mishandled ballots.

They do realize the cost. That is part of their agenda to remove firearms. Make the cost prohibitive for as many folks as they can.

Some didn’t realize, some didn’t care . . . it’s all the same in the end. They’re chipping away. Chipping away.

The law will not allow you to do that. The gun will have to go to a certified man who will determine whether it should be repaired or destroyed. New parts will have to have a serial number applied.

Of course none of this is practical and none of it’s going to happen IMO (in the near future at least.)

I wonder if anyone in the government really read this statement beforehand????? Criminals and others barred from owning guns don't procure them legally in the first place or worry about background checks thus how are you going to prevent crimes. So the bottomline is focused on helping law enforcement trace guns that were used in criminal activity. No change from today!!!!!!!!!!!!!!!!

The left are not fans of the constitution. These are people that would like to pack the Supreme Court with ideologues that would legislate from the bench, the constitution be damned. The 2nd they see as an obstacle, not a right.

The words Garland, Biden, Schumer, Pelosi, or whoever is behind the curtain do not matter. Their agenda is the real problem and they no longer try to conceal it.
