The Low Lights of Liberal Bill C-21
Yesterday Prime Minister Justin Trudeau, Public Safety Minister Bill Blair, Deputy PM Chrystia Freeland and Justice Minister David Lametti took to the airwaves to announce their sweeping new ‘gun control’ election platform, Bill C-21.
Before we look at what’s in Bill C-21, it’s important to take note of what’s not contained in this draft legislation.
Firearm Confiscation Compensation
Both the Prime Minister and the Minister of Public Safety said this legislation was required in order to implement their much-talked-about Firearm Confiscation Compensation program.
Not one line of Bill C-21 deals with funding for a compensation package for firearm owners who agree to surrender their legally-acquired firearms to the government.
Quote: “Details of a buyback program will be announced later.”
New Safe Storage Requirements
The federal government appears to leave any new firearm storage requirements in the hands of individual municipalities. Bill C-21 says an individual must store their firearms in compliance with any municipal storage requirements that may be issued.
Quote: “comply with strict storage conditions (to be prescribed) and confirm periodically they are still in compliance.”
So what’s in the bag?
Now we can get to what’s included in Bill C-21. This legislation will, if passed, redefine ‘replica firearm’ to include pellet and BB guns.
On Twitter, Doctors for Protection from Guns moronically called these items “gateway guns” in their effort to demonize childhood.[ii]
Make it a criminal offence to unpin a “high-capacity” magazine: Possession of a “high-capacity” magazine was already a crime. No explanation was offered for why we need a new criminal offence for these magazines.
Allow anyone to make an ‘ex parte’ application for a Firearms Prohibition Order against another person: After decades of dealing with the current Firearms Act ‘red flag law’ we know many complaints are made to “get back at” or “punish” a former intimate partner, not because there is a legitimate fear for personal safety. The ‘ex parte’ application contained in Bill C-21 will likely see this percentage of abusive and baseless complaints rise significantly.

Allow police officers to enter your home without a warrant.
Bill C-21 will allow police officers to enter a home without a warrant to “search for and seize any such thing, and any authorization, licence or registration certificate relating to any such thing, that is held by or in the possession of the person.”
Note the legislation does not say the subject of these invasive measures must be a gun owner. All that’s required to set this train wreck in motion is for someone to lodge a complaint.
When the state can enter your home – “search for and seize any such thing” – without a warrant, we no longer live in a nation of laws. We live in a nation of cancel culture, wokeness and second-class citizens where anyone, not just firearm owners, can be attacked using this provision.
Increase the maximum penalty from 10 to 14 years for some Criminal Code offences.

Since the current penalties for Sections 95, 96, 99, 100 and 103 are almost certainly unconstitutional (the primary reason Private Members Bill C-238 was defeated last week), this change seems pointless since the penalties will be tossed out by the Supreme Court when they are eventually challenged.[iii]
Municipal Handgun Ban
The primary emphasis of Bill C-21 is to allow municipalities to ban handguns within their municipal boundaries and possibly the creation of so-called “central storage facilities” using existing firearm businesses.
(a) the individual must not — within the boundaries of a municipality — store a handgun at a place other than a business that is the holder of a licence that authorizes it to store prohibited firearms or restricted firearms, in the case where
(i) a by-law to that effect is in force in the municipality,
(ii) the municipality has notified the federal Minister, in the prescribed manner, of the passing of the by-law, and
(iii) the municipality has provided the prescribed information to the federal Minister, or a person designated by that Minister, in the prescribed manner;
The municipal handgun ban cannot take effect until 180 days after a notice is sent to the Minister “in the prescribed manner” and includes “the prescribed information” – neither of which is defined in C-21.
No Explanation for Constitutional Overreach
The federal government has no jurisdictions over cities as they are the creation of provincial authorities. The federal government does not explain how their patchwork handgun bans will survive a constitutional challenge.
These are some of the provisions contained in the Liberal Government’s pre-election platform on firearms.
Not one line of this legislation addresses criminal misuse of guns. It focuses entirely on licensed, RCMP-vetted, firearm owners – AGAIN!
But Wait! There’s More!
There is much more to come from Bill C-21 as we’ve only scratched the surface in today’s brief overview of the legislation’s low-lights.
We will do our utmost to unravel the complicated mess created by Public Safety Minister Bill Blair and Justice Minister David Lametti and explain it to you, as best we can, in the days and weeks ahead.

This short explainer vid from Rod at the CCFR fits with the title of this thread....this one regarding the Docs for Protection from Guns and their ridiculous and horribly disingenuous use of 'facts' to back up their claims. Not in this video but others by the CCFR, that indicate the docs group are more interested in the power to bring the hammer down on firearms owners they deem a risk to society than anything else and are NOT open to discussing or debating their positions either.

 
I'm also curious to know just how far the feds will go to 'locating' all these firearms that were never registered (legally never required registration = non-restricted firearms) in the first place? Will they subpoena all existing sales records from any and all remaining retailers who lawfully sold these firearms since the former long gun registry was terminated? I don't doubt for a single second that it hasn't been weighed, considered and indeed may play a part in future plans if this legislation becomes law.

They can subpoena whatever they want from dealers/distributors, it will only show firearms sold by serial #. Non restricted firearm sales are not recording your name or license(As you know). Even if they’re happens to be a non restricted that is recorded, all one has to say is "I sold it".

Just like the newly introduced provision (part of theft back program) to keep your newly-prohibited "NR" you have to "register" it, basically creating another (Long Gun Registry) while turning it into a safe queen. Not happening, it will be a hide and seek scenario for many until this Lieberal government is ousted.

Here's where there may be some difference from province to province depending on the CFO and how heavy handed they are...I've had my info taken down for NR purchases in the past. But, it is not a consistent practice for sure. I've heard that both the BC & ON CFO offices have reputations for being pretty surly at times. My dealings directly with BC CFO have been limited as I've only ever owned one restricted firearm.
 
At one time firearms sold in stores were not serialized. There are a lot if these still in circulation and there was no point of sale records kept. Good luck tracking down every firearm.

They, the anti's and the government have done a great job demonizing gun owners for voter brownie points. They've also had some success in creating outright fear of gun owners, like every one of us is the next mass murderer in waiting. I can see them continuing to keep up the divisive rhetoric and outright lies about gun owners until they achieve their goal of total civilian disarmament. I couldn't agree more that they will use that fear to motivate the "Karens" you mentioned to call the cops because they're scared and were menaced by me when I walked out to my truck in the driveway with a gun case. Stupid $h*t like that is happening and more is coming...of that I am sure.
 
In the video about intellectual malpractice one theme stood out to me. The references to "the whole world", "other countries", "country after country", "the United States". All of the leftists on the planet are in this scheme together un the guidance of the U.N.. It is their grand scheme for their elite class (caste) to rule the rest of us with an iron hand.

Earlier this week, Prime Minister Trudeau announced his government's intent to crack down on gun crime. By Thursday, he had conversely brought forward legislation that would reduce sentences for gun crimes such as trafficking and importing, in addition to reducing minimum sentences for those convicted of more than one gun offence.

“In some of our cities, gun crimes are on the rise. This is unacceptable,” Trudeau said to reporters. “No one should be afraid of being a victim of a sniper or a stray bullet. As a parent, I know full well that our greatest fear is receiving a tragic call, telling us that the worst has happened.”

Surely, this goes against his promise made earlier this week. One need only look at the recent provisions in Bill C-22 to see where the Trudeau government really stands on firearms issues.


The mandatory minimum sentences that will be removed for gun offences include the following:


– The use of firearm in commission of offence

– Possession of restricted or prohibited weapons knowing possession is unauthorized

– Possession of a loaded handgun

– Possession of weapon obtained through crime

– Weapons trafficking

– Unauthorized import/export of firearm

– Illegal discharge of a firearm with intent

– Robbery with firearm

– Extortion with firearm


The government claims these changes are necessary to deal with systemic racism, as lower-risk and first-time offenders are disproportionately of an indigenous or Black background, and that said minimum sentences do not adequately deter crime.

“These are people with health problems. These are single mothers. These are young people who perhaps have made a couple of mistakes,” Justice Minister David Lametti said while introducing his bill.


Lametti also made claims on Thursday that mandatory minimum sentences are both a failed Conservative policy and unpopular with Canadians. As the Toronto Sun aptly notes, this is also incorrect.

Mandatory minimum sentences have existed since the tenure of Pierre Trudeau, who introduced some into law, as did his Liberal successors.

Although the Harper government began using minimum sentences in response to light sentences for serious crimes, voters largely approved of the measures.

One need only look at this example to see where the Trudeau government's priorities lie - not with disarming criminals who pose a harm to society, but law-abiding Canadians through the arbitrary removal of any gun deemed an "assault weapon."
 
Trudope also brought forth Bill C-21 prior to Bill C-22 banning Airsoft, Paintball, and Pellet firearms if this Bill is passed. Now someone please explain to me how this is going to stop gang/criminal violence. Bill C-21 was introduced in the House of Commons on February 16, 2021. The Bill is essentially a series of amendments to existing laws, most importantly the Criminal code and the Firearms Act, and, to a much lesser extent, other federal legislation.

Here is an overview:

HARSHER MAXIMUM SENTENCES FOR CERTAIN FIREARMS RELATED OFFENCES:

The maximum sentence for the offences listed hereafter (when prosecuted by indictment) is increased from 10 years to 14 years:

  • Possession of prohibited or restricted firearm with ammunition in an unauthorized location (s. 95 CC)
  • Possession of weapon obtained by commission of offence (s. 96 CC)
  • Weapons trafficking (s. 99 CC)
  • Possession for purpose of weapons trafficking (s. 100 CC)
  • Importing or exporting knowing it is unauthorized (s. 103 CC)
CREATION OF NEW CRIMINAL OFFENCE: ALTERATION OF MAGAZINE CAPACITY

Possession of a magazine exceeding the prescribed maximum capacity was already illegal. A person who modifies a magazine now commits two separate offences instead of one.

SOME AIRGUNS BECOME “PROHIBITED DEVICES” FOR TRANSFER AND OTHER SPECIFIC PURPOSES

Air guns that are currently exempt from licensing and registration requirements, because they do not meet muzzle energy or velocity thresholds (e.g.CO2 powered pistols) will be reclassified as prohibited devices for transfer purposes, if they are identical to or closely resemble modern firearms that are subject to licensing. Current owners will apparently be allowed to keep them, but they will not be allowed to transfer them to third parties. The loss (or finding) of such an air gun will have to be reported, failing which the owner becomes liable to criminal prosecution.

EMERGENCY PROHIBITION ORDERS

The bill allows any person to make an ex parte (i.e., without prior notification to the person concerned) application to a provincial court judge to obtain a temporary firearms prohibition order, valid for 30 days. In essence, this change allows a person with safety concerns to bypass the police and go straight to court. Upon service of the order by a police officer, firearms will be seized, pending the outcome of a hearing for a longer-term prohibition order. There is huge potential for malicious use of these provisions, especially in the context of domestic and other disputes. This will also be an additional burden on an already backlogged court system.

FIREARMS THAT WERE PROHIBITED PURSUANT TO THE MAY 1, 2020 ORDER IN COUNCIL.

Although the Government says their so-called “buy-back” is still in the plans, the bill does not address the so-called “buy-back”, or the indemnities to be paid.

The bill purports to repeal the provisions of the Firearms Act that provide for grandfathering with limited usage (i.e., paragraphs 12(8) and (9)). Instead, it provides for “storage” only grandfathering. In other words, existing owners will be given the option to keep their prohibited firearms, solely as collection items, and without possibility of use, sale, transfer, gift, or acquiring other firearms of the same class. There will also be ongoing compliance requirements.

Other firearms that may in the future be re-classified as prohibited by way of regulations will be subject to the same rules. This is the evergreen clause that the Liberals have been alluding to.

AUTHORIZATIONS TO CARRY HANDGUNS FOR THE PROTECTION OF LIFE

The authority to issue ATCs for the protection of life is being taken away from provincial Chief Firearms Officers and granted to the Commissioner of Firearms (the RCMP). This is likely in response that certain provinces such as Alberta, who have recently appointed a gun owner friendly CFO, might be tempted to issue those ATCs. At last count, there was only one such ATC issued in all of Canada, for the protection of life.
Chief Firearms Officers retain jurisdiction to issue ATCs in connection with professional purposes (e.g. trappers, security guards, prospectors)

IMPORTING OF AMMUNITION

A person (other than a non-resident) entering Canada with ammunition will be required to exhibit a valid firearms licence.

MUNICIPAL PROHIBITIONS ON STORAGE OF HANDGUNS

The Bill recognizes that municipalities may enact by-laws that prohibit the storage of handguns. However, it does not grant them the power to do so. Municipalities are creatures of the provinces. That power will necessarily come from the provincial legislation that they are subject to.

Should municipalities enact such by-laws and to the extent that those municipalities notify the Federal Public Safety Minister, licensed gun owners will be required to comply. There will be a 180-day phase-in period. After that, for affected gun owners, storage of handguns will only be allowed at authorized central storage facilities. Transportation of handguns to and from a location within one of those municipalities will not be authorized. Ranges located within a municipality that has enacted such a by-law will likely be forced to offer centralized storage services in order to remain in operation.

Collectors will be likely affected, as they will no longer be able to store their collection of handguns at their place of residence, should the municipality they live in pass such a by-law.

The apparent rationale for this new scheme is that the Government considers that handguns are at too high a risk to be stolen if they are stored at home.

SUSPENSION OF FIREARMS LICENSES

Chief Firearms Officers will be granted the power to suspend firearms licenses. A suspension can be for such period of time as the CFO determines. While a license is suspended, usage and acquisition of firearms, ammunition is prohibited. The targeted licensee will not be required to surrender or dispose of their firearms, unless the license is subsequently revoked.

The decision to suspend a license does not appear to be challengeable under s. 74 of the Firearms Act.

SURRENDER OF FIREARMS WHILE LICENSE REVOCATION/NON-RENEWAL IS BEING CHALLENGED.

Individuals who opt to challenge a non-renewal/revocation of their firearms license under s. 74 of the Firearms Act will be forced to surrender all of their firearms to police while the challenge is pending.

FIREARMS ADVERTISING

No firearms advertising may depict, counsel or promote violence against persons. This prohibition might encompass any advertising promoting self-defence and, potentially, some tactical sports.

ENLARGED POWERS TO REGULATE HANDGUN STORAGE

The Government is granting itself new powers to enact storage regulations that are specific to handguns. Based upon earlier statements and Minister mandate letters, it is expected that safes or vaults will become mandatory. That power will also apply to the required specifications for central storage facilities.

It's all such a crazy nightmare right now that I can't hardly believe it. The government efforts to malign and criminalize legal gun owners are so blatant and in your face it's impossible to miss. It is an unmistakable gut punch followed up with a slap in the face, all the while gaslighting the everlovin' crap out of everyone that "we're not targeting legal gun owners" and people are lapping this $h#t up!

I thought things were bad back in 1996 when we had to get licensed and the long gun registry was implemented...that was just a stepping stone to today. Thankfully we had a reprieve with successive Conservative governments or we'd all be down to single shots only by now. The abolishing of the long gun registry in 2012 has given us 9 going on 10 years of non-restricted firearms purchases that the government has no clue where they are now. Albeit, I'd guess that more than 95% of those still reside with a licensed owner though not necessarily the original purchaser.

I have no doubt that if we continue with more Liberal governments, they will ban all semi-auto centerfires, pumps and levers too. They may allow a provision for pumps or levers for licensed hunters but I kinda doubt it. They have a fetish for Australian gun control laws. My guess is single shot and bolt actions will remain with magazine capacity limits for bolt guns too. They'll prolly tax the crap out guns, accessories and ammo.

Sorry to be a bummer but single shot Weatherby rifle has been banned, the anti gunners want them all.
And the ban has gone beyond the 1500 models and variants, the reason why most are unaware is because the RCMP do not allow public access to the Firearm Reference Table. RCMP Entraps Licensed Gun Owners


The RCMP entrapped thousands of licensed gun owners when they reclassified 354 formerly Non-Restricted and Restricted firearms as Prohibited without notifying anyone. These were the firearms reclassified after May 6, 2020.


There is no requirement in law for the RCMP to notify gun owners of classification changes even though they put firearm owners in legal jeopardy – a problem we’ve long fought to change.


Seemingly, the RCMP’s reclassifications were performed under the guidance of Public Safety Minister Bill Blair and with the blessing of Prime Minister Justin Trudeau.


The result of the RCMP’s bureaucratic malfeasance is thousands of licensed firearm owners now illegally possess Prohibited weapons in contravention of Section 91(2) of the Criminal Code[ii].


Unauthorized possession of prohibited weapon or restricted weapon


91(2) … every person commits an offence who possesses a prohibited weapon…without being the holder of a licence under which the person may possess it.


Back on May 1st, 2020, the federal Liberal government of Justin Trudeau, operating under the guidance of Public Safety Minister Bill Blair and the RCMP, reclassified over 1,500 makes and models of firearms as “Prohibited.”


This massive gun ban included firearms that were Non-Restricted and Restricted on April 30th, 2020, and an amnesty was introduced to protect those owners from prosecution for possession under Section 91(2) of the Criminal Code.


Then on May 6th, 2020, the RCMP, presumably under the direction of Public Safety Minister Bill Blair, began reclassifying hundreds of Non-Restricted and Restricted firearms as Prohibited that were not on the May 1st list.


Owners of these arbitrarily reclassified Prohibited firearms are NOT protected by the May 1st amnesty order.


The government makes this clear in the text of SOR/2020-96. [iii]


The Order Declaring an Amnesty Period (2020) (the Amnesty Order) accompanies the Regulations to protect individuals, who were in lawful possession of one or more of the newly prohibited firearms or prohibited devices on the day the Regulations came into force, from criminal liability for unlawful possession for the purpose of allowing individuals to come into compliance with the law.


The amnesty order (SOR/2020-97[iv]) only protects owners of firearms specifically listed in the gun ban by Order in Council.


Words have meaning - "specific" means"clearly defined or identified" - something the RCMP's made-up "variant" is not. In fact, the recently released RCMP definition of what a "variant" is so vague and non-specific that it is laughable.


In other words, if your newly-prohibited firearm is not specifically listed in the OiC, you do not have the protection of the amnesty and you could be criminally charged for the mere possession of your own property.


Many thousands of gun owners are now at the mercy of the RCMP, Public Safety Bill Blair and Prime Minister Justin Trudeau.


What could possibly go wrong?

First, Justin Trudeau and Bill Blair reclassify over 1,500 makes and models of firearms as Prohibited and destroy the value of millions of dollars of legally-owned property to advance their political agenda.


Then the RCMP reclassified 354 firearms (and counting) as Prohibited, knowing full well that the thousands of licensed firearm owners who possess these firearms have no legal protection from criminal charges.


This is how the RCMP, Bill Blair and Justin Trudeau keep Canadians safe? By sacrificing those who obey all laws and follow every regulation to the letter?


Are the owners of these newly prohibited (and non-amnestied) firearms going to face criminal charges if they try to turn the firearms in to the authorities?


This once again illustrates the total lack of respect for licensed RCMP-vetted firearm owners displayed since Bill Blair and Justin Trudeau took office.


This can’t possibly end well for our community.
